Regulation of the Regime for the Promotion of the Knowledge Economy
On December 20, 2020, Decree No. 1034/2020 was published. The Decree regulates Law No. 27,570 on the Regime for the Promotion of the Knowledge Economy, which aims to promote new technologies, generate added value, promote quality employment, contribute to the growth of small and medium-sized companies, increase software exports, and create conditions for the development of nanotechnology, biotechnology, audiovisual, aerospace, robotic, nuclear and satellite industries, among other activities. Additionally, on January 14, 2021, the Ministry of Productive Development published Resolution No. 4/2021 by which complementary and clarifying regulations on the Regime were approved.

Data protection news for 2021
In Argentina, we are expecting some changes and news regarding the protection of personal data in the upcoming year. The half-sanction in Congress of Convention 108+, the presentation of a new comprehensive reform bill of Laws No. 25,326 and No. 26,951 and the resignation of the Director of the Agency of Access to Public Information (“AAPI”), the national data protection authority, bring about new perspectives as well as some uncertainties for 2021. .

 


 

New inspections procedure of the national data protection authority
On December 31, 2020, Resolution No. 322/2020 of the Access to Public Information Agency (“AAPI” or “Agency”) was published, approving a new inspection procedure to assess the level of compliance of controllers and processors with current data protection regulations.

Central Bank of Argentina issued new regulation to prevent stereotyping in the financial sector
On November 12, 2020, the Central Bank of the Argentine Republic issued Communication “A” 7162, which established that financial institutions should avoid practices or actions that reflect or promote stereotyped and hierarchical views of gender, androcentrism, sexist language, media-related and/or symbolic violence against women and LGBTTIQ+ people. Among other things, advertisements must avoid male patronizing behavior (mansplaining), using images of women as a mere object unrelated to the product it is intended to promote or associated with stereotyped behaviors, or reproducing homophobic, lesbophobic and transphobic messages.
